Data Protection – Use of Data
(a) Information about you
We will send the information you provide when you apply, transaction details relating to your application and details we obtain from elsewhere (as described below) to the Bank (which offers financial products and services under the Post Office® brand), other companies in the Bank of Ireland group (including Midasgrange Limited, a company owned by the Bank of Ireland UK and Post Office Ltd) so that they can consider your application as described below. Your details are "personal data" under the Data Protection Act 1998.
The Bank will then hold your information and any other information it has about you on its electronic databases and use it in the following ways.
(I) Considering your application
To help the Bank decide whether to enter into an agreement with you, it will search your record at any relevant credit reference agencies, such as Experian Limited and/or Equifax Europe (UK) Limited. A record of the Bank's search will be made and this will be available to other organisations who make similar searches.
The Bank may also use information it gains from your performance of any other agreement you have with it or any of its subsidiary or associated companies or its ultimate holding company ("the Bank's Group") or any other company providing services to you under the Post Office® brand. It may also use a credit scoring system.
(II) Use and disclosure of your information
We will add to your record with any relevant credit reference agencies by giving information relating to your agreement and information about your payment record. Should any payment be overdue, we may also tell them of that fact. We may check your details with a fraud prevention agency. If false or inaccurate information is provided and fraud is identified, details will be passed to fraud prevention agencies. Law enforcement agencies may access and use this information. We and other organisations (including Our Group and any other company providing services under the Post Office® brand) may also access and use this information to prevent fraud and money laundering, for example, when:
i) checking details on applications for credit and credit related or other facilities
ii) managing credit and credit related accounts or facilities
iii) recovering debt
iv) checking details on proposals and claims for all types of insurance and
v) checking details of job applications and employees.
We and any other organisations may access and use from other countries the information recorded by fraud prevention agencies. Please contact us at NIIB Group Ltd, 32 Central Avenue, Bangor, Co Down, BT20 3AS if you want to receive details of the relevant fraud prevention agencies. We may also give information about you and your agreement to:
i) your insurer;
ii) anyone acting on its behalf, including Our Group and other companies providing services under the Post Office® brand
iii) any finance house or motor trader
iv) companies or other bodies which maintain registers of assets and interests in them
v) any relevant regulator and
vi) credit industry fraud avoidance networks,
for the purposes of managing your account and our business, administration, underwriting and processing. We may also disclose personal information about you and this Agreement to any prospective/actual assignee, transferee or chargee of our interest under this Agreement.
(b) Direct marketing
If you have agreed to us doing so, we will pass the information we have about you to other companies in the Post Office and Royal Mail group, to the Bank, to other companies in the Bank of Ireland group and to Midasgrange Limited (including Midasgrange Limited, a company owned by the Bank of Ireland and Post Office Ltd) who will hold your details on their marketing databases. We, and these other companies, may contact you from time to time, by the methods (and about the products and services) to which you have agreed. If you change your mind about being contacted by any of these companies, please write to us at Data Protection Officer, Post Office Financial Services, PO Box 27, Temple Quay, Bristol, BS99 7AX.
(c) Your right to information
You have a legal right to receive a copy of the information we holds about you if you apply in writing to Data Protection Officer, Post Office Financial Services, PO Box 27, Temple Quay, Bristol, BS99 7AX. A small administrative fee may be payable.
