  1. These terms and conditions (“Terms”) apply to Post Office Limited’s Drop & Go service. By signing the application form for this service You have accepted these Terms
  2. Post Office Limited is referred to in these Terms as “Post Office Ltd” or “We”, “Us”, “Our”, as appropriate
  3. “Postal Services Terms” means the relevant terms relating to the collection, conveyance or delivery of mail, as contained in:
    (i) any scheme made by Royal Mail Group Limited (or any successor to it) under section 89 of the Postal Services Act 2000 (or any re-enactment or amendment to it)
    (ii) any contract relating to postal services between You and Royal Mail Group Limited or any successor to it
    (iii) any contract relating to postal services between You and any other postal services operator notified to You by Us, or
    (iv) any contractual provisions contained in any separate contract(s) governing the supply of the postal services that You can purchase through Online Postage, in each case as they apply to any item in a Drop & Go Mailing
  4. “Last drop off time” refers to the last time in the day as stated [in the branch] that you will be permitted to drop off Your mail, for processing that same working day
  5. “Manifest form” is the form that You must complete in order to complete Your handover of mail for processing. On this form You will write details of Your mail items and which services You require
  6. “Postal charges” means any postage, fees, charges or other amounts and any applicable VAT payable, pursuant to the relevant Postal Services Terms in respect of an item in a Drop & Go mailing
  7. Our registered office is at 100 Wood Street, London, EC2V 7ER
  8. As a customer of the Drop & Go service, you are referred to in these Terms as “You” or “Your”
  9. The Drop & Go service will be available at participating Post Office® branches only. We may withdraw the Drop & Go service completely, or from a previously participating branch or branches, at any time, providing You with prior notice where possible
  10. You will be required to comply with our identification requirements when opening or closing an account or changing any details. These will be available from the branch
  11. Drop & Go Service
    11.1 Subject to You complying with the requirements set out in these Terms, We will permit You to deposit mailings of Your mail items which do not bear either stamps, a franking machine impression, a postage label or a printed postage impression (“Drop & Go Mailings”) at those counters in participating Post Office branches designated by Us as for use (not necessarily exclusively) by Drop & Go customers (“Drop & Go counters”) for subsequent processing by the participating Post Office® branch on your behalf
    11.2 Subject to You complying with the requirements set out in these terms and conditions, the participating Post Office® branch will process each of Your Drop & Go Mailings on your behalf by calculating and applying postage and any other fees or charges payable in respect of each such mailing, issuing a time and date stamped certificate of posting for each requested item in the mailing (“Certificate of Posting”) and making the mailing available for collection in the usual way by the relevant postal service operator (eg Royal Mail Group Limited)
    11.3 The Drop & Go service does not include any element of the collection, conveyance or delivery of the mail items in a Drop & Go Mailing. These elements are carried out by the relevant postal service operator(s) (once a Certificate of Posting is issued) not by Us
    11.4 Each participating Post Office branch prescribes a last drop off time by which You must deposit a Drop & Go Mailing at the Drop & Go Counter. Last Drop Off Times may vary, and may also change over time, and You are responsible for finding this information out from the participating Post Office branch
    11.5 Post Office Ltd will aim to process any Drop & Go Mailing which You deposit at a Drop & Go Counter before the Last Drop Off Time and which complies with the requirements of these Terms on the same working da
  12. Conditions of Service
    12.1 In using the Drop & Go service You agree to the following:
    vi(i) that these Terms apply;
    vi(ii) that, as a condition of Post Office Ltd processing Your Drop & Go mailings, You shall, prior to depositing a mailing at the Drop & Go counter:
    • ensure any mail you deposit is Eligible Mail (Clause 14)
    • accurately complete a Drop & Go Manifest Form which includes the following details: Your customer identity number, Your name and Your contact details, a list of all the mail items You are depositing including the value and the postal service you require for each mail item (eg Royal Mail First Class, Second Class, Special Delivery by 9am etc) and any permitted special instructions for each item
    • ensure the Manifest Form clearly states what is in the package and its value and that you understand that the Manifest Form is not a proof of purchase or a Certificate of Posting
    • ensure that You have sufficient monies on your account to enable Us to properly process Your Drop & Go Mailing in accordance with Your Drop & Go Manifest Form and pay the Postal Charges payable on that mailing and You acknowledge and agree that Post Office Ltd reserves the right not to process any Drop & Go Mailing either wholly or partly if it appears that You have not previously paid to Post Office Ltd sufficient money to cover the Postage Charges payable on it

    When depositing a mailing at the Drop & Go counter:

    • ensure that the Drop & Go Manifest Form and Your mail is marked correctly and is fully completed by You
    • ensure that You present Your Identity Card to the Post Office® counter clerk for checking
    • When you have finished depositing a mailing at the Drop & Go counter:
    • ensure that you have received a receipt from the Post Office® counter clerk and that it has the correct number of items;
    v(iii) to Post Office holding the monies provided by You as pre-payment for Postage Charges due in respect of Your Drop & Go Mailings (which shall be refundable to You in accordance with these terms below);
    v(iv) that should You wish to withdraw any monies in credit on Your account, this will require a minimum of [5] working days;
    iv(v) that although Post Office Ltd will endeavour to carry out basic verification checks when presented with an Identity Card, You are responsible for ensuring that Your Identity Card is not lost, stolen or misused by anyone and will notify Us immediately You become aware that Your Identity Card has been lost, stolen or misused;
    v(vi) to Post Office Ltd deducting from the monies provided by You all Postage Charges;
    i(vii) that Post Office Limited will not be obliged to pay You any interest in respect of any monies provided by You or on Your behalf that We hold on account for Drop & Go Mailings;
    i(vii) that Post Office Ltd’s calculation as to the amount of Postal Charges due in respect of a mail items included as part of a Drop & Go Mailing (as evidenced on the receipt provided to You) shall be final (subject to Our obvious error or negligence and to the postal service operator’s rights to recover any underpaid Postal Charges from either You or the recipient of the mail item);
    (viii) that Post Office Ltd will not provide you with a postage receipt at the time when you deposit a Drop & Go Mailing but at later date (being no sooner than [1] working days after the date of deposit and in any event no later than [1] working days after the date of deposit of the mailing);
    v(ix) that You must check Your receipts and the balance shown on them when You receive them and must raise any query on them with Us by contacting your participating branch within 14 days of being given the receipt;
    vi(x) that You will provide Us with a copy of the receipt for any Drop & Go mailing dispute you wish to make;
    v(xi) that a mail item included in a Drop & Go mailing shall not be considered to be in the course of transmission by post until Post Office Ltd has successfully completed processing it as described in clause [7] and a Certificate of Posting has been issued; and
    i(xii) that You will be bound by all applicable Postal Services Terms in accordance with clause [13] below13.
  13. Your Agreement to Relevant Postal Services Terms
    13.1 By using the Drop & Go service:
    vii(i) You are deemed, when You deposit a Drop & Go mailing, to accept all applicable Postal Services Terms of the relevant postal services operator in respect of each mail item in the mailing and You acknowledge and agree that such terms shall apply between You and the relevant postal services operator, and that Post Office Ltd shall not be a party to such terms;
    vi(ii) You agree that, if there is any difference of opinion between You and Post Office Ltd as to which terms apply to a mail item in a Drop & Go Mailing or which method of posting applies to a mail item, the terms and/or method which Post Office Ltd deems applicable shall apply; and
    iii) You shall be deemed to have accepted the current version of such terms when You deposit a Drop & Go Mailing at a Drop & Go counter 
    13.2 Information on relevant Royal Mail and Parcelforce service standards and the current versions of applicable Royal Mail and Parcelforce Postal Services Terms are available from the Royal Mail website and/or the Parcelforce Worldwide website, and/or on request. Information on the postal services terms of other postal service operators is available from the relevant postal service operator
  14. Eligible Mail Items
    14.1 Mail items shall only be eligible for processing under the Drop & Go service if:
    ivi(i) they may be conveyed and delivered in accordance with at least one of the postal services available and specified on the Royal Mail website and/or the Parcelforce Worldwide website [and/or the website of any other postal service operator notified by Us to You in writing at any time];
    viii) they comply with all Postal Services Terms applicable to the mailing of that item; and
    v(iii) they are properly marked (including Your address as the return address), packaged and sealed, and You have correctly completed any required forms (for example, customs forms for international items
  15. Addressing any Issues
    15.1 If for any reason there are any problems regarding Your Drop & Go Mailing (for example, if on any occasion that You deposit a Drop & Go Mailing You have not paid Post Office Ltd in advance sufficient money to cover Postal Charges for all the mail items or if for any reason We are not confident that We can accurately Process any mail item) We will endeavour to contact You using the telephone number You have provided
    15.2 If We are unable to contact You for any reason and/or We are unable to resolve any problems with Your Drop & Go Mailing to our satisfaction We will: 
    vi(i) process in no particular order, any mail items for which We have received sufficient payment from You; and/or
    vi(ii) subject to clause [11.3], hold Your affected mail items for a maximum of eight (8) days from the date of deposit, or until You collect them or until You pay sufficient Postal Charges, whichever is the sooner
    15.3 If We have been unable to address any issues with Your Drop & Go Mailing or any mail items in it within a maximum of eight (8) days of the date of deposit of the mailing at a Drop & Go counter, We reserve the right to return all or part of it to You (at Your cost, which may include a surcharge from the postal services operator) and shall have no liability to You as a result
    15.4 We reserve the right to amend any transaction which is not correct due to ‘human error’
    15.5 If You have any questions, comments or complaints about the Drop & Go service, please contact Your participating Post Office® branch
  16. Postal Services Terms
    16.1 Nothing in these Terms affects Your rights or obligations as regards a postal services operator under the Postal Services Terms. Your entitlement or otherwise to compensation for lost, damaged or delayed mail items (including those forming part of a Drop & Go Mailing once a Certificate of Posting has been issued) is subject to and in accordance with the provisions of the relevant Postal Services Terms
  17. Exclusion of Liability
    17.1 Post Office Limited will be responsible for loss, damage or delay of a mailing item handled by Us under these Terms up until the point Your mailing item receives a Certificate of Posting as follows: where a mailing item is lost, damaged or delayed as a result of the negligence or breach of these terms by Us or Our employees or agents, We will pay You by way of compensation an amount equivalent to what You would have been entitled to receive for the item if the postal services operator had been responsible for it under and in accordance with the relevant Postal Services Terms
    17.2 Once we have issued a Certificate of Posting for a mailing item, legal liability for it (including liability for loss, damage or delay) passes to the relevant postal services operator and will be determined in accordance with the Postal Services Terms
    17.3 To the fullest extent permitted by law and however such losses arose and whether as a result of a breach of these Terms or as a result of any negligent act or omission or otherwise, on the part of Post Office Ltd, its employees or agents, We exclude all further or other liability to You for any of the following losses that You may suffer or incur in connection with the Drop & Go service: loss of business; loss of goodwill; loss of data; loss of opportunity; loss arising from any loss of or damage or delay to any mailing item in a Drop & Go Mailing loss of profits, whether or not any such losses were foreseeable, arose in the normal course of things or We were advised of the possibility of such losses; and losses that were not reasonably foreseeable by both parties at the time these Terms commenced
    17.4 Under no circumstances will you be entitled to make a double recovery on any claim under this Agreement. Where a double recovery claim is made by You, We are entitled to recover the monies back from You and inform any other company/person you made the claim against of the double recovery 
    17.5 Nothing in these Terms excludes or limits our liability to You for any death or personal injury resulting from our negligence
  18. General
    18.1 You will only be able to use the Drop & Go service in participating Post Office branches when they are open for business. Opening hours for Post Office® branches vary and You are responsible for finding this information out 
    18.2 You are not permitted to use the Drop & Go service to deposit mail items on behalf of a third party
    18.3 Post Office Ltd may withdraw the Drop & Go service from You or vary these Terms at any time on giving You not less than fourteen (14) days’ notice in writing at the address You have provided to Us 
    18.4 In addition, Post Office may withdraw the Drop & Go service from You immediately at any time on giving written notice to You:
  • in the event that You have committed a serious or material breach of these Terms;
  • in Our opinion, the reputation or the business of Post Office Ltd or its parent, subsidiaries or sister companies is or may be seriously adversely affected in any way by Your actions; or
  • You become insolvent

    18.5 You may withdraw from the Drop & Go service at any time by visiting Your relevant Post Office Branch and requesting to close Your account
    18.6 You must return to the relevant Post Office® branch [Post Office Ltd] immediately on expiry or termination or withdrawal of the Drop & Go service any Identity Card or other materials provided by Post Office Ltd in connection with the Drop & Go service
    18.7 In the event of termination or withdrawal of the Drop & Go service, Post Office Ltd shall within 14 days (and provided You have complied with clause [18.6] above) return any monies it has received from You to the extent that they have not been utilised for and are not required to cover Postage charges on any Drop & Go mailing. Termination will not affect Our rights to recover from You any unpaid or underpaid Postal charges
    18.8 The rights granted under these Terms are personal to You and You may not assign, transfer or license any of the rights or obligations granted under these terms without the prior written consent of Post Office Ltd. Nothing in these Terms confers on any third party any benefit or the right to enforce any clause of these terms
    18.9 You undertake that You shall not make any statements or claims that indicate that Post Office Ltd has approved or recommended any goods or services offered by You and/or Your agents
    18.10 Any failure or delay by You or Us in enforcing (in whole or in part) any provision of this agreement will not be interpreted as a waiver of Your or Our rights
    18.11 These terms and any non-contractual obligations or liabilities arising out of or in connection with the performance of this agreement is governed by and will be construed in accordance with English law. Each party submits to the exclusive jurisdiction of the Courts of England and Wales
    18.12 The headings in these terms are included for convenience only and will not affect their interpretation
    18.13 If any provision or part of a provision, of these Terms is found by any court or authority of competent jurisdiction to be unlawful, otherwise invalid or unenforceable, such provision or part-provision will be struck out of these terms and the remainder of these terms will apply as if the offending provision or part-provision had never been agreed
    18.14 Post Office Ltd does NOT provide the Drop & Go service as the agent of Royal Mail Group Limited or any other postal services operator
